1. Terms of Service
You agree that by your use of Your Faithful Legacy’s Site and Services, you are old enough to enter into a legally-binding agreement in your state of residence and these Terms of Service (“Agreement”) constitute a legally-binding agreement between Your Faithful Legacy and you and you consent to be bound by them and all other laws and regulations that may apply. If you do not agree with the Terms of Service as provided herein, please do not use the Site or Services. Intellectual property laws protect the Materials as identified and described below.
You further agree that if a dispute arises from your use of Your Faithful Legacy Materials or Services, binding arbitration will be used to resolve the matter as set out in more detail below.
The following definitions apply in these Terms of Service:
- Content – Software, graphics, documents, explanations, templates, forms, content, photographic images, audio files, video files, images, text, graphics, illustrations, trademarks, patents, copyrights, service marks, logos, and other information or products protected by intellectual property rights.
- Materials – Self-help documents and other forms or information we provide with our Services.
- Your Faithful Legacy – Your Faithful Legacy LLC, a California limited liability company, the owner and operator of the Site and Services, and our officers, directors, employees, agents, representatives, consultants, partners, suppliers, licensors, and affiliates.
- Services – The Site, Content, Materials, and all other services.
- Site – www.yourfaithfullegacy.com and any other website that Your Faithful Legacy may provide to users in the future.
- You – Each user of www.yourfaithfullegacy.com or any of our Services, including the employer, company, or organization you access on behalf of the same, who you warrant agree to be bound by this Agreement.
- We, us, our – Your Faithful Legacy.
2. Privacy Notice In Addition To These Terms Of Service
Your use of our Site, your use of any Services we offer, and our offering of any Services to you may also be subject to additional terms or policies, including our Privacy Notice. We may offer Services that are subject to additional terms and policies specific to those Services. By using any such Services, you acknowledge that you have read and agreed to be bound by any such additional terms and policies in addition to these Terms of Service.
3. Disclosure Regarding Legal Advice
Your Faithful Legacy is not a lawyer or law firm. It does not offer legal advice or legal services. We do not engage in the practice of law. We provide access to software, information and self-help forms for you to use at your own risk. They do not substitute advice from a licensed attorney in your jurisdiction. If you have any questions about your particular situation or any of the forms on this site, we recommend you contact a licensed attorney in your jurisdiction for individual legal advice and guidance. No attorney-client relationship exists between you and Your Faithful Legacy or its affiliates through the use of this site or our services. Communications are not protected by attorney-client privilege, nor are any of our forms considered attorney work-product.
Your Faithful Legacy will not and does not provide advice, opinions, or professional guidance concerning legal issues or tax matters that may arise from the use of the Materials. We also do not provide fixes for problems you might encounter when trying to use said Materials. Your Faithful Legacy does not review any portion of your Materials to make sure they are accurate, fit for a particular purpose, spelled correctly, or use consistent names, address, or other identifiers. Likewise, Your Faithful Legacy does not provide advice, opinions, or professional guidance about your unique situation. Your Faithful Legacy does not apply any special expertise for your situation. Your Faithful Legacy provides general information freely available to the public. As such, this information is not specific to a particular person’s or entity’s situation.
While it is our aim to maintain updated Materials through our Services, you acknowledge that this does not constitute personalized legal, accounting, financial, or tax advice. This site is designed to provide information and self help resources to people who have basic estate planning needs, and you acknowledge that the Materials may not fit your needs or be appropriate if your needs exceed these parameters. Your Faithful Legacy does not warrant that any of the Services are accurate, complete, current, or comply with the laws of your local jurisdiction. The foregoing disclaimers of warranties do not apply to North Carolina consumers.
Your Faithful Legacy may make changes to any of the Services at any time without notice. However, Your Faithful Legacy does not guarantee to update any of the services at any particular interval.
4. Disclosure Regarding Tax Advice
Your Faithful Legacy does not provide tax advice or accounting advice or services of any type or for any purpose. Your Faithful Legacy is not a tax firm or accounting firm. Any information regarding taxes or accounting in any communication from Your Faithful Legacy is intended only for general education and is not to be construed or relied on as tax or accounting advice.
Although Your Faithful Legacy does not provide any tax or accounting advice, we do provide this disclosure to comply with requirements imposed by the Internal Revenue Service under Circular 230:
We inform you that any U.S. federal tax advice contained in any communication from Your Faithful Legacy is not intended or written to be used, and cannot be used, for purposes of (a) avoiding penalties under the Internal Revenue Code or (b) promoting, marketing, or recommending to another person any matters addressed therein.
5. Disclosure Regarding Financial Advice and Features
Your Faithful Legacy does not provide any financial advice or investment advice of any type, for any purpose. Your Faithful Legacy is neither a financial advisory firm nor an investment advisory firm. Any financial information or investment information presented through the Site or Services is intended for educational purposes only, and is not to be construed as or relied upon as financial or investment advice.
Your Faithful Legacy cannot guarantee the accuracy of any data provided through a third party integration on our website. Any graphics or content presented within the Your Faithful Legacy tools and services regarding your financial assets is intended solely for informational purposes, and may not represent an accurate picture of your finances or financial health.
6. Retention Of Rights
Except as provided in these Terms of Service, Your Faithful Legacy retains all rights in the Services and Materials. The Services and all materials therein or transferred thereby, including, without limitation, the Content and all intellectual property rights related thereto, are the exclusive property of Your Faithful Legacy and its licensors. Except as explicitly provided herein, nothing in these Terms of Service shall be deemed to create a license in or under any such intellectual property rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from any materials or content accessible on the Services. Use of the Services for any purpose not expressly permitted by this Agreement is strictly prohibited.
You may choose to or we may invite you to submit comments or ideas about the Services, including without limitation about how to improve the Services or our products (“Ideas”). By submitting any Idea, you agree that your disclosure is gratuitous, unsolicited and without restriction and will not place Your Faithful Legacy under any fiduciary or other obligation, and that we are free to use the Idea without any additional compensation to you, and/or to disclose the Idea on a non-confidential basis or otherwise to anyone. You further acknowledge that, by acceptance of your submission, Your Faithful Legacy does not waive any rights to use similar or related ideas previously known to Your Faithful Legacy, or developed by its employees, or obtained from sources other than you.
7. Use License
Your Faithful Legacy grants you a limited license. Subject to your compliance with these Terms of Service, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable license to use the Services as designed and as set forth in these Terms of Service. Your Faithful Legacy reserves all rights not expressly granted herein in the Services. Your Faithful Legacy may terminate this license at any time for any reason or no reason.
According to the terms of this license, you agree not to engage in any of the following prohibited activities: (i) copying, distributing, or disclosing any part of the Services in any medium, including without limitation by any automated or non-automated “scraping”; (ii) using any automated system to access the Services in a manner that sends more request messages to the Your Faithful Legacy servers than a human can reasonably produce in the same period of time by using a conventional on-line web browser (except that Your Faithful Legacy grants the operators of public search engines revocable permission to use spiders to copy materials from publicly accessible web pages at yourfaithfullegacy.com for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials); (iii) transmitting spam, chain letters, or other unsolicited email; (iv) attempting to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the Services; (v) taking any action that imposes, or may impose at our sole discretion an unreasonable or disproportionately large load on our infrastructure; (vi) uploading invalid data, viruses, worms, or other software agents through the Services; (vii) collecting or harvesting any personally identifiable information, including account names, from the Services; (viii) using the Services for any commercial solicitation purposes; (ix) impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity; (x) interfering with the proper working of the Services; (xi) accessing any content on the Services through any technology or means other than those provided or authorized by the Services; (xii) bypassing the measures we may use to prevent or restrict access to the Services, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Services or the content therein; (xiii) modifying the Materials or Services; (xiv) attempting to decompile or reverse engineer any software contained on Your Faithful Legacy’s Site; use the Materials or Services for any commercial purpose, or for any public display (commercial or non-commercial); (xv) removing any copyright or other proprietary notations from the Materials or Services; (xvi) or transferring the Materials or Services to another person or “mirroring” the Materials or Services on any other server.
If you violate these Terms of Service, this license will automatically terminate. Further, Your Faithful Legacy can terminate this license at any time.
Furthermore, you acknowledge that using the Services may necessitate that you input personal, confidential, or proprietary information related to a third party. In such incident, you warrant you have secured all necessary rights and permissions from any such third party and grant the same to Your Faithful Legacy to utilize the information to provide the Services and that your use of any such information does not violate any rights of a third party, including privacy and intellectual property rights.
Subject to the other provisions of these Terms of Service, Your Faithful Legacy grants you permission to download, view, copy and print Document Materials on any single, stand-alone computer or device solely for your personal, informational, non-commercial use. You agree that you will not download, view, copy, print, replicate or modify the Document Materials in whole or part other than authorized editing or in the course of making a document accurate or effective for your actual individual use of the document for the purpose for which that kind of document exists. This permission terminates automatically without notice if you breach any of the terms or conditions of these Terms of Service. On any such termination, you agree to immediately destroy any downloaded or printed Document Materials and to cease using the service. Any unauthorized use of any Materials contained on the Site or available through the Services may violate copyright laws, trademark laws, laws of privacy and publicity and communications regulations and statutes.
8. Limitation Of Liability
To the maximum extent permitted by applicable law, in no event shall Your Faithful Legacy, its affiliates, agents, directors, employees, suppliers or licensors be liable for any direct, indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, that result from the use of, or inability to use, this Services. Under no circumstances will Your Faithful Legacy be responsible for any damage, loss or injury resulting from hacking, tampering or other unauthorized access or use of the Services or your account or the information contained therein. To the maximum extent permitted by applicable law, Your Faithful Legacy assumes no liability or responsibility for (i) any errors, mistakes, omissions or inaccuracies of content or materials; (ii) any personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our Services; (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein; (iv) any interruption or cessation of transmission to or from the Services; (v) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party; (vi) any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Services; and/or (vii) the defamatory, offensive, or illegal conduct of any third party. Your Faithful Legacy explicitly disclaims any and all liability and/or responsibility for any disclosure of information that may be deemed confidential by you or any third party. In no event shall Your Faithful Legacy, its affiliates, agents, directors, employees, suppliers, or licensors be liable to you for any claims, proceedings, liabilities, obligations, damages, losses or costs in an amount exceeding the amount you paid to Your Faithful Legacy hereunder. This limitation of liability section applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Your Faithful Legacy has been advised of the possibility of such damage. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. This paragraph does not apply to North Carolina consumers.
9. Disclaimer of Warranty
The Services are provided on an “as is” and “as available” basis. Use of the Services is at your own risk. To the maximum extent permitted by applicable law, the Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. No advice or information, whether oral or written, obtained by you from Your Faithful Legacy or through the Services will create any warranty not expressly stated herein. Without limiting the foregoing, Your Faithful Legacy and its licensors do not warrant that the content is accurate, reliable or correct; that the Services will meet your requirements; that the Services will be available at any particular time or location, uninterrupted or secure; that any defects or errors will be corrected; or that the Services are free of viruses or other harmful components. Any content downloaded or otherwise obtained through the use of the Services is downloaded at your own risk and you will be solely responsible for any damage to your computer system or loss of data that results from such download or your use of the Services. This paragraph does not apply to North Carolina consumers. Your Faithful Legacy does not endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Your Faithful Legacy Services or any hyperlinked website or service, and Your Faithful Legacy will not be a party to or in any way monitor any transaction between you and third-party providers of products or services.
10. Indemnification Clause
You agree to defend, indemnify and hold harmless Your Faithful Legacy and its agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Services, including any data or content transmitted or received by you; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third-party right, including without limitation any right of privacy, publicity rights or intellectual property rights; (iv) your violation of any law, rule or regulation of the United States or any other country; (v) any claim or damages that arise as a result of any information you input via your account; or (vi) any other party’s access and use of the Services with your unique username, password or other appropriate security code.

The Site and Services may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Your Faithful Legacy. Your Faithful Legacy does not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access a third party website from the Services, you do so at your own risk, and you understand that these Terms of Service and Your Faithful Legacy’s Privacy Notice do not apply to your use of such sites. You expressly relieve Your Faithful Legacy from any and all liability arising from your use of any third-party website, service, or content. Additionally, your dealings with or participation in promotions of advertisers found on the Services, including payment and delivery of goods, and any other terms (such as warranties) are solely between you and such advertisers. You agree that Your Faithful Legacy shall not be responsible for any loss or damage of any sort relating to your dealings with such advertisers.
12. Modification Of Site Terms Of Service
Your Faithful Legacy reserves the right to modify these Terms of Service and is not required to provide you with any notice before making such changes. This page will post the most current version of these Terms of Service. These terms become immediately effective upon posting. We may notify you of significant changes of these Terms of Service via email if you are a registered user, and you consent to receive such periodic communications to effectuate this process. By continuing to use this Site and our Services, you agree to be bound by the most recent version of these Terms of Service. You can check the most recent version of these Terms of Service by looking at the date at the top of the webpage where these terms are displayed.
13. Notification Procedures
Your Faithful Legacy may give users notifications as the law requires or for its own marketing or other commercial purposes through email or posting on this Site, as determined by Your Faithful Legacy in its sole discretion. Your Faithful Legacy is not responsible for any automatic filtering of email that you or your email provider may apply to notifications we send to the email address you have provided us.

14. Arbitration As The Sole Means Of Resolving Disputes
This section of the Agreement outlines how disputes, claims, and controversies related to Your Faithful Legacy’s Services (hereinafter “disagreement”) will be resolved. Please seek legal counsel if you do not understand these terms or their legal effect.
Your Faithful Legacy is committed to resolving any disagreement that arises out of or related to this Agreement or its breach. In the event we are unable to resolve the disagreement, Your Faithful Legacy and you proactively agree to submit any unresolved dispute to binding arbitration, according to the terms provided below (the “Arbitration Agreement”).
Binding Arbitration Rules: In case of a disagreement related to these Terms of Service or Your Faithful Legacy’s Site, or a breach thereof, you and Your Faithful Legacy agree to resolve it by binding arbitration administered by the American Arbitration Association (“AAA”) under the Commercial Arbitration Rules and Consumer Arbitration Rules. Any court with jurisdiction can enter judgment on the arbitrator’s award. The AAA arbitration rules and forms are located on its website, which are incorporated herein by reference. You can also call the American Arbitration Association for additional information or answers to questions about its rules or procedures by calling 1-800-778-7879. As a result of these Terms of Service, the AAA rules may be changed expressly or impliedly. The Federal Arbitration Act governs the interpretation and applicability of this Arbitration Agreement. Your Faithful Legacy and you further agree that the United Nations Convention on Contracts is excluded and not applicable to this relation.
Arbitration Initiation: The Party, whether you or Your Faithful Legacy, who chooses to initiate the proceedings must provide a written notice to the other Party in accordance with the American Arbitration Association rules and forms. The written notice must be addressed to Your Faithful Legacy LLC, Attn: Legal Department.
Single Arbitrator: Whenever possible, to conserve costs and increase simplicity, a single arbitrator shall hear claims arising from these Terms of Service, unless the Parties expressly agree otherwise. The Parties shall select the arbitrator from the AAA’s roster of consumer dispute arbitrators. If they are unable to agree on which arbitrator to appoint, the AAA rules will govern the arbitrator’s selection.
Venue: California shall be the venue for any arbitration hearings described in this section. The Commercial Arbitration Rules related to in-person hearings shall apply.
Arbitrator Limitations: To the maximum extent permitted by law, the arbitrator will have no authority to do any of the following: award any type of damages to the prevailing Party that are not calculated based on the damages said Party actually sustained, including any damages otherwise permitted under state or federal law to punish a Party; award consequential damages; or provide an award of injunction, specific performance, or any other award that is not for money damages.
Class Action, Jury and Bench Trial Waiver: Your Faithful Legacy and you hereby agree that, except as provided below, arbitration shall be the sole form of resolution of any disagreement arising out of these Terms of Service and that no such claim or dispute will be subject to a jury or bench trial in any court or tribunal. Both Parties agree to forfeit the right to a jury trial. Furthermore, Your Faithful Legacy and you expressly waive any rights to join a class action in any capacity, and that unless both Parties expressly agree, the arbitrator cannot consolidate more than one person’s claims in the arbitration proceedings. Your Faithful Legacy and you agree that the United Nations Convention on Contracts is excluded and not applicable to this proceeding or case.
Fees: Each Party is responsible for paying all applicable filing fees, administrative expenses, and arbitrator fees as provided by the AAA rules. If your claim for damages is $75,000 or less, and is not ruled as frivolous or based on improper purpose (as set forth in the Federal Rules of Civil Procedure 11(b)) by the Arbitrator, Your Faithful Legacy will pay all such fees.
Award: The award shall be provided under the timeframe rules of the American Arbitration Association. Any award provided must meet the following guidelines: the award shall not affect other parties; the ruling shall not be conferred to another case or Party; the award must include findings and conclusions; neither party shall have the right to appeal the award; and the award must coincide with these Terms of Service. Your Faithful Legacy hereby waives the right to recover administrative expenses and attorney fees if it prevails in arbitration.
Exceptions to Arbitration: Your Faithful Legacy and you retain the legal right to seek injunctive or equitable relief to protect intellectual property rights and to initiate legal proceedings in any court of competent jurisdiction to exercise such right. Additionally, each Party retains the right to initiate legal proceedings in small claims court.
Miscellaneous: This Arbitration Agreement will continue to govern the dispute resolution of the Parties upon termination of the Terms of Service. Arbitration proceedings, findings, and rulings are confidential and shall not be disclosed by either party, except as may be required by law.
Changes: Notwithstanding Your Faithful Legacy’s right to modify its Terms of Service as indicated above, you have the right to reject any changes to this section that are made after you first accepted these Terms of Service or any subsequent modification of these Terms of Service by providing written notice to Your Faithful Legacy within 30 days of the change’s effective date, including by email. By rejecting any change, you agree you will arbitrate any disagreement between Your Faithful Legacy and you according to the provisions of this section that applied at the time you first accepted these Terms of Service or any subsequent modification of these Terms of Service.
15. Governing Law
Any legal claim related to your use of Your Faithful Legacy’s Site shall be governed by the Arbitration Agreement discussed in these Terms of Service. If, under the exceptions clause of said provision, Your Faithful Legacy or you commence a judicial proceeding, the laws of the State of California shall govern such proceeding, without regard to its conflict of law provisions.
You proactively consent to personal jurisdiction in California to resolve any dispute between Your Faithful Legacy and you that may arise out of these Terms of Service or related to Your Faithful Legacy’s Site. You agree that state and federal courts in California are the exclusive venue for any dispute that may arise under these Terms of Service. The foregoing paragraph shall not apply to North Carolina consumers.
16. Payment For Services
You agree to pay us in accordance with our terms of sale. Certain aspects of the Services may be provided for a fee or other charge. If you elect to use paid aspects of the Services, you agree to the terms of sale, pricing, payment, billing policies, and refund policies applicable to such fees and charges. Your Faithful Legacy may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion. You authorize Your Faithful Legacy to charge your credit card for all fees and charges incurred in connection with your use of the Services, including Your Faithful Legacy’s fees, government fees, taxes and other third party fees.
If you register with us, you may cancel your account at any time; however, there are no refunds for cancellation. All purchases are final and refunds are discretionary and may be considered on a case-by-case basis in accordance with our refund policy. In the event that Your Faithful Legacy suspends or terminates your account or these Terms of Service, you understand and agree that you shall receive no refund or exchange for any Content, any unused time or service on a subscription, any license or subscription fees for any portion of the Services, any content or data associated with your account, or for anything else.
You agree to pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the Services at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions.
17. Assumption of Risk and Consent
You provide us your data at your own risk and consent to have it processed in the United States. We care about the privacy of our Users. You consent to have your personal data collected, used, transferred to and processed in the United States. We have implemented commercially reasonable technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration or disclosure. However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information for improper purposes. You agree that you provide your personal information and other data provided to Your Faithful Legacy at your own risk.
You must ensure security and integrity of your account. When you open an account to use or access certain Services or provide us with information in connection with a purchase or transaction, you must provide accurate, complete and current information. You will also be asked to provide a username and password. You are entirely responsible for maintaining the confidentiality of your password. You are solely responsible for the activity that occurs on your account, including when you use the shared access function if available on the Site. You share access to your documents at your own risk. You must keep your account password secure and you may not use a third party’s account at any time. Your Faithful Legacy shall not be liable for any losses you incur as a result of someone else’s use of your account. You may be held liable for any losses incurred by Your Faithful Legacy due to someone else’s use of your account.
18. Jurisdiction
Your Faithful Legacy Services are directed to users in the United States. The Services are controlled and operated from the United States. Your Faithful Legacy makes no representations that the Services are appropriate or available for use in other locations. Those who access or use the Services from other jurisdictions do so at their own volition and are entirely responsible for compliance with all applicable local laws and regulations, including but not limited to export and import regulations. You may not use the Services if you are a resident outside the United States, of a country embargoed by the United States, or are a foreign person or entity blocked or denied by the United States government. Unless otherwise explicitly stated, all materials found on the Services are solely directed to individuals, companies, or other entities located in the United States.
19. Assignment Of Rights
These Terms of Service are assignable only by Your Faithful Legacy. These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be transferred or assigned by Your Faithful Legacy without restriction.
20. Severability Of Agreement
This is our entire agreement and if any portion is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. This Agreement, together with any amendments and any additional agreements you may enter into with Your Faithful Legacy in connection with the Service, shall constitute the entire agreement between you and Your Faithful Legacy concerning the Services.
No waiver of any term of these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and Your Faithful Legacy’s failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision.
21. Access to a Deceased Member’s Account

Your Faithful Legacy does not provide or guarantee, and expressly disclaims, any value, cash or otherwise, attributed to any data residing on the servers running the Services.
